These Terms of Use (“Terms”) govern your access to and use of wedigutah.com and its content (the “Site”), operated by VanCon, Inc. (“VanCon,” “we,” “us,” or “our”). By accessing or using the Site, you agree to be bound by these Terms and by our Privacy Policy. If you do not agree, please do not use the Site.

“VanCon,” “We Dig Utah,” the VanCon logo, and other names, logos, taglines, and service marks displayed on the Site are trademarks or trade names of VanCon or their respective owners. You may not use them without our prior written consent, including in meta tags, hidden text, domain names, or any manner likely to cause confusion or to suggest sponsorship or endorsement that does not exist.

All content on the Site — including text, graphics, logos, photographs, project descriptions, layout, and design — is owned by VanCon or its licensors and is protected by copyright and other intellectual property laws. You may view, download, and print Site content for your own personal, non-commercial reference only, provided you keep all copyright and proprietary notices intact.

It is illustrative and may be summarized, rounded, or simplified. Nothing on the Site is a bid, quote, offer, warranty, or commitment, and nothing creates a contract between you and VanCon. Any work we perform is governed solely by a separately negotiated, signed written agreement.

When you submit a bid request, trade partner form, career inquiry, or other communication, you represent that the information you provide is accurate and that you have the right to share it. Please do not send confidential, proprietary, or sensitive information through the Site. Except for personal information, which we handle as described in our Privacy Policy, we may use submissions to respond to you and to operate our business.

The Site may link to third-party websites and services, including our hiring platform and social media pages. We provide these links for convenience only. We do not control, endorse, or assume responsibility for the content, products, or practices of any third-party site. You access third-party sites at your own risk and subject to their terms.

TO THE FULLEST EXTENT PERMITTED BY LAW, VANCON AND ITS OFFICERS, EMPLOYEES, AND AGENTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, REVENUE, DATA, OR BUSINESS INTERRUPTION, ARISING OUT OF OR RELATED TO YOUR USE OF (OR INABILITY TO USE) THE SITE, REGARDLESS OF THE LEGAL THEORY AND EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. SOME JURISDICTIONS DO NOT ALLOW CERTAIN LIMITATIONS, SO SOME OF THESE LIMITATIONS MAY NOT APPLY TO YOU.

You agree to indemnify and hold harmless VanCon and its officers, employees, and agents from any claims, losses, liabilities, and expenses (including reasonable attorneys’ fees) arising out of your misuse of the Site or your violation of these Terms or applicable law.

These Terms are governed by the laws of the State of Utah, without regard to its conflict-of-laws rules. You agree that any dispute arising out of or relating to the Site or these Terms will be brought exclusively in the state or federal courts located in Utah County, Utah, and you consent to their jurisdiction.

We may revise these Terms from time to time. When we do, we will update the “Effective date” above and post the revised Terms on this page. Your continued use of the Site after changes take effect means you accept the updated Terms.

If any provision of these Terms is found unenforceable, the remaining provisions will remain in full effect. Our failure to enforce any provision is not a waiver of it. These Terms, together with our Privacy Policy, are the entire agreement between you and VanCon regarding your use of the Site.
